This is the agreement between you and Imagecation when you use the app. Plain English, no surprises. By installing or using Imagecation you agree to what is below.
These terms are an agreement between you and Imagecation, an app operated by an independent developer (a sole individual) based in Vietnam. "We", "us", and "our" mean Imagecation. "You" means the person using the app.
Apple is the seller of record for every purchase (see section 5). For questions about this agreement, write to support@tourtour.app.
Imagecation is an iOS app that maps photo spots: places to stand, the direction to face where available, useful hours and months, and sun times computed for today at each position. The app uses Apple's Maps and Sign in with Apple as building blocks, and includes its own in-app turn-by-turn walking guidance to a spot.
The spot catalogue, the app, the brand, the logo and the code are ours. You get the right to use them as described below; you do not get to copy or resell them.
Map tiles load live from Apple Maps and need an internet connection.
You can use Imagecation if you are at least 16 years old, or the digital-consent age in your country if it is higher. Sign in with Apple already enforces Apple's age-based account rules, which we rely on.
You also need a compatible iPhone and an Apple ID.
Imagecation uses Sign in with Apple. We do not run a separate username-and-password system. When you sign in, Apple gives the app an opaque identifier so your subscription and saved data stay linked to you across devices, and nothing more. We never receive your email or your Apple ID. See the Privacy Policy for the full picture.
You are responsible for the security of the Apple ID you use to sign in.
Imagecation is unlocked by an auto-renewing subscription (monthly or yearly), processed by Apple through StoreKit. Pricing is shown in your local currency in the app before you confirm, and charged to the payment method on your Apple ID. We do not see your card or billing address.
An active subscription grants you a non-exclusive, non-transferable, personal licence to use every photo spot in every country the app ships, with the hours, months and directions the data carries, on devices signed in to your Apple ID.
The subscription renews automatically at the end of each period unless you cancel at least 24 hours before the renewal date. Cancel any time in Settings → Apple ID → Subscriptions, or from Manage Subscription inside the app. Cancelling stops the renewal; you keep access until the period you paid for ends. Prices for future periods can change; Apple notifies you and asks for consent where the law requires it.
Refunds go through Apple's standard process: open reportaproblem.apple.com or use Settings → Apple ID → Subscriptions. Apple decides; we cannot override their decision because we never received the money.
If you are an EU consumer, you have a 14-day right of withdrawal on the subscription. Apple, as seller of record, captures the consent and handles the withdrawal process; use the refund link above within the window.
The spots you bookmark and the days you plan are yours. They stay on your device (see the Privacy Policy). We do not read them, mine them, train models on them, or share them.
We grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the app while your subscription is active.

This one matters, so plainly: a spot is a record that people once stood somewhere, not a promise that you may or should stand there today.
We are not responsible for accidents, injury, fines or property damage that happen while reaching or standing at a spot. Use your judgement.
The spots, counts, directions, hours and months are a planning aid. Views change, trees grow, buildings rise, and access rules can change.
Spot names are cleaned automatically, so an occasional wrong or oddly worded name can slip through. Where the app is unsure, it says so on the spot rather than inventing a claim. Sun times are computed astronomically for today and are accurate; whether the sky cooperates is between you and the weather.
If a spot is plainly wrong, tell us at support@tourtour.app with the spot and the problem. Corrections ship as free data updates.
We try to keep Imagecation available. Sometimes it will not be, due to maintenance, infrastructure outages, or Apple-side StoreKit hiccups. We do not promise uninterrupted service and we do not owe a credit for downtime.
If we ever discontinue the app, active subscribers keep access for the period they paid for, and auto-renewal is switched off. We will write to you in the app before that happens.
To the maximum extent the law allows, Imagecation and its team are not liable for indirect, incidental, consequential, special or punitive damages arising from your use of the app, including lost data, lost opportunity, missed light, missed flights, or any decision you made because of what the app said.
Where the law does not allow us to exclude liability (for death, personal injury caused by negligence, fraud, or anything else a consumer law in your country guarantees), those rights remain. Nothing in these terms limits a right an EU consumer law gives you that cannot be waived.
If we are found liable despite the above, our total liability for any claim is capped at the amount you paid Imagecation in the 12 months before the claim arose.
You can stop using Imagecation at any time by cancelling the subscription and deleting the app. See the Privacy Policy for how data is removed.
We can suspend or end your access if you breach these terms, for example by scraping the spot catalogue, attempting to bypass entitlement checks, or using the app to do something illegal. If we end your access for breach, you are not entitled to a refund of the unused period.
We may update these terms to reflect new features, new laws, or to fix wording. When we do, we update the "Last updated" date at the top and, if the change is material, surface it inside the app before it takes effect. Continuing to use Imagecation after a material change means you accept the new version.
